General Terms and Conditions of 199Jobs.com

These general terms and conditions regulate the services, rights and duties between you, the user (hereafter: You or User) and 199Jobs.com (hereafter: 199Jobs)

1. Service Provided
199Jobs facilitates a service, which allows individuals to sell and/or buy services from other 199Jobs Users, using the 199Jobs.com website.

On 199Jobs.com everyone can create a free profile and post as many jobs as they like. Sellers may post the same job only once. Duplicated or very similar jobs will be deleted. Jobs are priced starting at 199 Philippine Pesos.

Only registered users can buy and sell on 199Jobs, registration is free of charge. Duplicate accounts are not allowed.

2. Services aka Jobs
Buyers are granted all rights for the delivered work, unless otherwise specified directly by the seller to the buyer.

Jobs, which includes uploaded sample works and the work output delivered to buyers, must not contain: adult material or X-rated services, pirated software, plagiarized content, stolen intellectual digital property.

In addition, we do not allow posting of business opportunities, commission-based work, offline errands, competing services and any illegal service or product. We also do not allow selling of long-term items such as hosting, domains and subscriptions.

We also do not allow selling of digital goods like music, ebooks, software, themes, images, videos, serial keys, apps, emails, online currency, visitors, traffic, and so on. Included here are products that are owned by other sites, such as “likes”, “followers”, user accounts, and so on. Selling of jobs that violate the Terms of Service of other sites is not allowed.

Failure to comply with the above will lead to banning involved users and forfeiting any earnings from doing any of the jobs above. 199Jobs reserves the right to decline and delete any job and suspend a user, without a reason stated.

3. Buyer Protection
199Jobs invests a lot of time and effort into making sure all jobs on 199Jobs meet our Quality Guidelines. Incomplete orders will be cancelled and credited to the Buyer’s 199Jobs store credit balance.

4. Terms of Payment
All jobs must be paid through our approved payment gateways or 199Jobs store credit balance at the time of ordering. 199Jobs holds the payment and pays it to the Seller after the Buyer has accepted the job. 199Jobs collects a percentage service fee on all transactions.

Users are not permitted to offer or accept payments using any method other than through those provided by 199Jobs. Failure to do so will result in banning of the user accounts involved. Jobs should be ordered using the “Order Now” button.

Under no condition should buyers ask sellers to work before an order is placed. Failure to do so will result in the banning of the user accounts involved

4.a Store Credit
Store Credit is an onsite discount used to reduce the purchase price of a job, wherein 1 Store Credit = 1 PHP discount on the price of the job. Store Credit cannot be converted into cash, nonrefundable, and has no monetary value outside of 199jobs. Store Credit is only valid for six months after it is purchased. To purchase, visit our Buy Store Credit page. The 30-day money back guarantee only applies if the Store Credit is bought through 199Jobs and you have at least that amount of Store Credits on your balance. Payment processor fees will be deducted from the returned amount. If you used a credit card, this can take up to 30 days to process. We reserve the right to waive this guarantee.

5. Order Procedure
After payment has cleared, the Seller will be notified about the job and start working. Buyer will be notified of order status changes by email. After the Buyer accepts the work, the payment will be credited to the Seller’s account.

Users are not permitted to offer contact details, ask for contact details, or communicate with other 199Jobs users outside of the 199Jobs messaging system. This includes sending links to pages with contact details like portfolio pages and attaching contact details in files, such as text files and resumes, and asking other users to do so. Examples of contact details are video chat links, email addresses, phone numbers, links to chat services, and other similar ways of external contact. Doing so will get the involved user accounts banned.

6. Late Delivery
If Seller fails to complete order the order within a seven day grace period after the agreed deadline, 199Jobs may cancel the order and the payment refunded to the Buyer’s 199Jobs store credit balance. Late delivery has a negative effect on a Seller’s rating. Repeat offenders will have their accounts banned.

7. Mutual Order Cancellation
Both, Buyer and Seller may at any time mutually cancel the order without a negative effect on the seller’s rating. Payment from cancellations will be refunded to the Buyer´s 199Jobs store credit balance.

Please note that we discourage cancelling orders if the reason is outside the seller’s control. This includes cancelling because the output was rejected by a third-party (a buyer’s client, for example), subjective reasons, and personal reasons.

On the other hand, many sellers are willing to revise their work. Please ask the seller how many and what kind of revisions are included in your order.

8. Delivering Orders
199Jobs shall not be held liable for quality of jobs delivered. Buyers must choose carefully who they order from and should always check rating and comments from other users.

Sellers are required to send proof that they did the work for the order by attaching output in the order chat. Failure to do so will result in penalties such as delay of cashout, deduction to the seller’s balance, up to banning of accounts.

All disputes are to be solved between the Buyer and the Seller directly: if a Buyer is unhappy with an order, he/she should reject the delivered work and insist on the job delivery as described in the job description. Buyer should also leave a negative rating if he/she wishes to. The 199Jobs Buyer Protection will cancel late orders and refund the purchase to the Buyer´s 199Jobs Store Credit balance. We do not offer partial refunds.

9. Disputes
We encourage our buyers and sellers to resolve issues between themselves. If for any reason this process fails, you can contact us. If necessary, refunds will be deposited into the Buyer´s 199Jobs store credit balance. 199Jobs reserves the right to cancel and refund any order at any time without a reason.

10. Cashing Out Funds
Funds can be cashed out to the Seller’s bank account or via any of our accepted payout methods for completed orders. To be eligible for cash out, you must have a minimum user balance of Php 500.00. Please allow up to five (5) business days for payout requests to be processed. A seller’s user balance expires if that seller’s account remains dormant for six (6) months

11. Liability
199Jobs is an ecommerce platform and micro job service provider and is not directly involved in the jobs and especially in the quality of the job provided.

12. Limitations of Liability
Under no circumstance shall 199Jobs be liable for damages exceeding the purchase price of the job.

13. Payment Disputes
You agree to never file a payment dispute with our payment gateways. Contact us for help in solving payment issues.

14. Unsolicited Emailing
With the exception of certain verified opt-in mailings, 199Jobs prohibits any form of unsolicited bulk emailing and messaging (commonly referred to as “spamming”) by any user, either related or unrelated to 199Jobs.

User’s participation in verified opt-in mailings shall only be permitted upon prior written consent of 199Jobs. For the purpose of this Agreement, spamming also includes any similar, abusive behavior including, but not limited to automatically sending scripted text (and website URL) disguised as “chat” into any third party chat room, bulletin board or website.

Any report of spamming will be investigated immediately, and 199Jobs may, in its sole discretion, suspend the account of the User in question pending the review or investigation of the reported spamming. 199Jobs will terminate any user found, in its sole discretion, to have engaged in this prohibited behavior, and the termination provisions above will apply.

In addition, users are not allowed to take transactions outside the site, ask for contact or payment information, or send links to sites that compete with 199Jobs, potentially harmful sites like phishing or malware sites, illegal or unethical sites, and sites with disturbing content.

199Jobs reserves the right to take any other action it deems necessary in this regard, and further reserves the right to change these standards from time to time, to be effective upon notice to User.

15. Notifications
All notifications have to be made in writing and can be transmitted via email through our contact form.

16. Acceptance
User fully accepts these terms & conditions upon use of the 199Jobs.com website. 199Jobs may make changes to its Terms of Services and will make a copy of the latest version available at http://199Jobs.com/terms-of-service. You understand and agree that 199Jobs will treat your use as acceptance of the updated Terms of Service.

17. Severability Clause
Should one of the contract clauses become invalid, the validity of the remaining provisions as a whole shall not be affected. Instead of the invalid clause, what comes closest to the economical purpose of the clause is then agreed. Place of jurisdiction and place of fulfillment, to the extent permitted by law is Manila, Philippines.

18. Taxes
The User is not an employee of 199Jobs.com and is solely responsible for payment of any and all taxes attributable to compensation received in the performance of the Service.
